Partners Personnel Privacy Policy

Effective Date: February 11. 2025

In this Privacy Policy, we will use the terms “Partners Personnel,” “we,” “us,” and “our” to refer to Partners Personnel Management Services, LLC. This Privacy Policy describes our policies with respect to the collection, use, disclosure, and protection of information we collect through our websites, including www.partnerspersonnel.com, Work4Partners, and Partners Personnel mobile applications (collectively, our “Services”).

This Privacy Policy explains certain Partners Personnel privacy practices with respect to personal information about the following people:

  • The following residents of California:
  • Individuals we hire or contract with to work at our customers’ businesses (“Associates”), including when they interact with our timeclock.
  • Individuals who are applying to become Associates (“Candidates”);
  • Anyone (whether or not they live in California) who visits our websites outside their role as an actual or prospective Associates or Candidates (“Visitors”).

With respect to California Associates and California Candidates, this Policy applies regardless of the nature of the actual or potential working relationship (full-time employment, part-time internship, independent contractor relationship, etc.).  References to “employment” and similar terms in this Policy are for the purpose of referring generally to any kind of such working relationship (regardless of whether such relationship could be categorized as an employer/employee relationship under applicable law).  This Policy is not an agreement or suggestion that any individual is, was, or will be an employee or any other category of worker at Partners Personnel or at any customer of Partners Personnel.

 

Information We Collect

We will collect, use, and otherwise process the following categories of personal information about individuals, depending on their relationship with us:

  • identifiers, such as name, alias, postal address, unique personal identifier, email address, telephone number, recruiting account username, and government-issued identifiers such as Social Security numbers and driver license numbers;
  • audio or visual information, such as voicemails, teleconference recordings (presentations, web conferences, call recordings, etc.), photos, and security camera footage (from on-site visits);
  • internet, electronic network, and device activity and device information and related identifiers, such as IP address, record of browsing on our website or of interaction with an online job advertisement, other information described in the Cookies and Other Automated Data Collection subsection below, and, information about your use of systems owned, leased controlled, or used by Partners Personnel (e.g., computer networks, communication systems, and third-party cloud services) including user IDs, passwords, IP addresses, device IDs, web logs and (1) other records of access and use of such systems, (2) communications or other information transmitted to or from, printed from, or created, stored, recorded or accessed on such systems, and (3) data collected from the mobile device management tools.   • professional or employment-related information, education information, information, and other data in job applications, such as education, employment, employment history, licenses, professional memberships or affiliations, professional social media profile information (e.g., LinkedIn), resumes, CVs, cover letters, skills, certifications, qualifications, experience, academic transcripts, the results of assessments and tests given as part of the recruiting process, details about your desired working situation (such as willingness to relocate), details about how you heard about an open position, citizenship, and immigration status;
  • geolocation information, including precise geolocation information
  • biometric information collected by our timeclock
  • health and medical information about you, and if applicable, your beneficiaries, such disability status, health and safety incidents or accidents, sickness records, and health issues requiring accommodations to your working environment, working practices, or interview process;
  • financial information, such as compensation and benefit details, and bank account and tax information;
  • other characteristics of potentially protected classification information under California law (such as race, ethnicity, sexual orientation, gender identity, disability status, or veteran status, all collected on a voluntary basis for equal employment opportunity and diversity monitoring purposes);
  • our inferences about you.

We do not collect all of this data about all individuals, as needs vary by individual, certain data is optional, and local practices and legal requirements may vary.

Cookies and Other Automated Data Collection

When you use our Services, we and/or our vendors automatically collect certain information about your device and how you use the Services. This includes your IP address, browser type, browser language, operating system, the state or country from which you accessed the Services, software and hardware attributes (including device IDs), referring and exit pages and URLs, platform type, the number of clicks, search terms, files you download, domain names, landing pages, pages and features viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Services, error logs, and other similar information about how you use the Website. From your IP address, we may be able to infer your general location (e.g., city/state or postal code).

To collect this information, we and/or our vendors may use Internet server logs, local storage, cookies, tracking pixels, and other similar technologies to track, measure, and analyze the behaviors and usage patterns on our Services. Cookies are small text files that are placed on your computer or mobile device when you visit a site that enable us to: (i) recognize your computer; (ii) store your preferences and settings; (iii) understand the web pages of the Services you have visited; (iv) enhance your user experience by delivering and measuring the effectiveness of content and advertising tailored to your interests; (v) perform searches and analytics; and (vi) assist with security and administrative functions.

As we adopt additional technologies, we may also gather information through other methods.  You may set your web browser to notify you when you receive a cookie and to accept or refuse certain cookies. If you elect not to accept cookies, some functionality and areas of the Services may be restricted. To learn how to manage your cookies, please follow the instructions from your specific browser. If you access the Services via a mobile device, refer to the manufacturer’s instructions.

Uses of Data

We collect and use this data for a variety of reasons:

  • recruitment, which may include:
    • reviewing your application;
    • facilitating interviews (including, in certain cases, facilitating travel);
    • checking references;
    • conducting background checks;
    • conducting post-interview surveys;
    • notifying you of relevant additional vacancies that may interest you;
  • onboarding purposes, including:
    • documenting eligibility for work;
    • assisting with obtaining an immigration visa or work permit where required;
    • facilitating training; and
    • making improvements to our application/recruitment process;
  • administration of compensation, benefits and staffing, including:
    • engaging in general benefit plan and program administration;
    • providing a wellness program;
    • administering equity grants, options, and ownership;
    • considering personnel for role changes;
    • assisting with professional licensing and certifications;
    • succession planning;
    • providing internal updates regarding reorganization, promotions, etc.;
    • communicating with you and your plan beneficiaries;
  • logistics, safety, and systems and facilities maintenance for our facilities or those of our clients, including:
    • planning and arranging work supplies and workspaces (including remote work);
    • facilitating and administering the use of Partners Personnel property and resources, including systems owned, leased controlled, or used by Partners Personnel (e.g., computer networks, communication systems, and third-party cloud services), and protecting against unauthorized access;
    • managing workplace health and safety compliance;
    • providing access cards for restricted areas;
    • protecting the safety and security of Partners Personnel facilities and property (including the prevention of illegal activities);
    • conducting fitness for duty examinations;
    • maintaining and ensuring Partners Personnel equipment, account systems and services are working properly and as intended, including tracking outages or troubleshooting other issues
    • communicating with you and your emergency contacts
  • providing our products and services, including:
    • enabling Partners Personnel to comply with contractual obligations;
    • managing and fulfilling orders;
    • operating time clocks;
    • customer service purposes;
    • engaging in project management;
    • conducting product and service training;
    • ensuring employee productivity and adherence to policies;
    • maintaining an internal workforce directory;
    • arranging and facilitate meetings;
  • general business and administrative purposes, including:
    • managing licenses, permits, and authorizations applicable to Partner Personnel’s business operations;
    • facilitating business travel;
    • other expense reimbursement (e.g., GPS for mileage, use of Partner Personnel payment cards);
    • addressing legal and compliance matters;
    • supporting risk management and insurance functions, budgeting, financial management and reporting, and strategic planning including reductions in force and Partner Personnel reorganizations;
    • in connection with a corporate transaction, sale, or assignment of assets, merger, divestiture, or other changes of control or financial status of Partner Personnel or any of its subsidiaries or affiliates;
  • diversity and inclusion, including:
    • supporting internal programs and initiatives;
    • tracking and reporting DEI statistics;
  • analysis and improvement, including:
    • conducting surveys and audits;
    • workforce reporting and data analytics, as well as analytics and measurement to understand use of various accounts, systems, and services;
    • analyzing workforce satisfaction data;
    • conducting research and development;
    • conducting quality assurance and improvement;
  • customer relations and other external communications, including:
    • promoting Partners Personnel as a place to work
    • engaging in marketing, advertising, and promotion
    • communications with prospective, current, and former customers
    • providing a directory and contact information for prospective and current customers and business partners
    • providing external updates/press releases regarding reorganization, promotions, awards, research and development, etc.
    • administering Partner Personnel-sponsored events and public service activities
  • general communication purposes, including:
    • operating our websites;
    • communicating about job opportunities;
    • sending schedule or assignment changes;
    • providing emails regarding Partners Personnel products/services;
  • otherwise communicating with you; and
  • addressing other legal, compliance, and risk matters.

 

As described further below, some of our disclosures of California personal information qualify under the California Consumer Privacy Act (“CCPA”) as what it defines as a “sale” or “sharing” of personal information.  During the 12 months leading up to the effective date of this Privacy Notice, we “sold” and “shared” (as those terms are defined under the CCPA), what the CCPA calls “identifiers” (like IP addresses), “internet or other electronic network activity information” (like information regarding an individual’s browsing interactions on a website), and “commercial information” (like the fact that a browser visited a page directed to people who are considering use of our staffing services) to third parties that assist us, such as marketing providers and analytics providers.  This practice continues today.  To our knowledge, we do not “sell” or “share” (as those terms are defined under the CCPA) the personal information of individuals under 16 years of age.  To opt out of such “sales” and “sharing,” California residents can follow the instructions  Here:  https://www.partnerspersonnel.com/opt-out-preferences

How long will Partners Personnel keep my personal information?

It is our policy to dispose of personal information after we determine it is no longer necessary. Where personal information is kept beyond the time that we would need to keep it, that period will be determined based on applicable federal, state, and local laws. Because we may collect and use the same category of personal information for different purposes and in different contexts, there is not typically a fixed retention period that always will apply to a particular category of personal information. To provide security and business continuity for the activities described in this statement, we make backups of certain data, which we may retain for longer than the original data.

How does Partners Personnel collect my information?

We collect Visitor data through our websites.  We collect California Candidate and California Associate data:

  • During the recruitment process, such as in interviews
  • If applicable, in preparation for the start of the working relationship
  • If applicable, during the working relationship

At times, we may also receive data about you from third-party sources, including:

  • Our customers
  • Our affiliates
  • Recruiters and other referral sources
  • Other services that assist us with our operations, such as a travel agency
  • Your former employers, and other references you provide
  • Publicly available sources, such as your professional profile on Facebook and LinkedIn or your employer’s website

Disclosures of Personal information

Partners Personnel may disclose your personal information to third parties, including:

  • To customers in connection with an actual or potential assignment with them;
  • To other Partners Personnel-affiliated companies;
  • To third parties and business partners that provide services to us (“Vendors”), such as providing insurance coverage, hosting a recruitment system, analyzing data to improve performance and recruiting practices, and otherwise assisting in our operations;
  • To law enforcement agencies, courts, regulators, arbitrators/arbitral forums, federal/state/local administrative agencies, and other government authorities (collectively, the “Governmental Entities”);
  • To protect our rights, your rights, or the rights of any third party, or to otherwise address legal matters; and
  • In connection with a merger, acquisition, or other significant corporate transaction.

In the 12 months before the Effective Date of this Privacy Policy, we made the following disclosures of California personal information that we collected during that time:

CCPA Rights

This section does not apply to personal information or practices that are exempt from the notice provisions of the California Consumer Privacy Act (“CCPA”), such as background checks conducted pursuant to the Fair Credit Reporting Act.

If you are a California resident, the CCPA permits you to request that we:

  • Provide access to and/or a copy of certain information we hold about you;
  • Delete certain information we have about you;
  • Correct certain personal information we have about you; and
  • Inform you about the categories of personal information we have collected about you in the preceding 12 months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we have disclosed certain personal information, and more specific detail about what categories of information, if any, were “sold,” “shared” or disclosed to particular categories of third parties, similar to the detail in this Privacy Policy.

Please note that certain information may be exempt from certain requests under California law. For example, we need certain information to evaluate job applications, so we may reject a deletion request for that information if you still wish for us to evaluate your job application, or we may give you the opportunity to withdraw your application.

We reserve the right to require verification of your identity before we fulfill a request, which may include requiring you to login to an existing Partners Personnel account, providing us with information that matches our records for you, responding to an email we send, or taking other steps relevant to your relationship with us and the nature of your request.

If you are an agent making a request on behalf of an, we reserve the right to take steps to verify that you are authorized to make that request, which may include requiring you to provide us with written proof such as a notarized authentication letter or a legally sufficient power of attorney signed by the data subject pursuant to California Probate Code sections 4121 to 4130, or other written authorization acceptable to us. We also may require the consumer to verify their identity directly with us where permitted. For clarity, this is not permission for any individual to disclose their login credentials to an agent or any third party. Such disclosure is prohibited and is not required for an agent to make requests under this Policy.

For security and legal reasons, however, Partners Personnel does not to accept requests that require us to access third-party websites or services.

You have a right not to face retaliation or receive other “discriminatory treatment” (within the meaning of the CCPA) for the exercise of the privacy rights conferred by the CCPA.

We do not use California “sensitive personal information” (as defined by the CCPA) in a manner that would require us to comply with the CCPA obligation to offer individuals a special right to limit our handling of that data due to its sensitive nature.

Partners Personnel Security Practices

We take certain steps as part of an effort to protect personal information but cannot guarantee the security of your personal information.

Notification of Changes

Partners Personnel may change this Policy at any time, such as to reflect changes in the law, our data collection and use practices, and advances in technology. The current version will be hyperlinked from the recruiting section of our main website.
